This short yet replete critique coherently relates to the scholarly audience the accurate understanding of takfir (charging someone with infidelity) according to the great mujtahid Imam, Taqi al-Din Subki (may Allah have mercy on him). By presenting various fatwas and texts of Imam al-Subki, the article examines the rule of Subki on the “intention of the offender” which it reveals has been distorted by Nuh Ha Mim Keller in “Iman, Kufr and Takfir” due to three primary reasons:

 

a) Little knowledge about the different levels of entailment (luzum) and their grades of reliability in the Islamic law,

B) Decontextualisation of the passage in which Subki presents the rule and

c) Lack of study on the topic of takfir as a whole and hence confusion about matters in which there is Ijma.

This work is perhaps the first scholarly examination of the rule of Imam al-Subki from his al-Sayf al-Maslool ala man Sabba al-Rasul [The Naked Sword upon the Person who Insults the Messenger (Allah give him peace and blessings)] which primarily uses the writings of Subki to reply to “Iman, Kufr and Takfir”.
